Bus Driver Fired For DUI Can Go Back to Work, Judge Says

John Trusz had sued the Easton Area School District after he was fired for an off-duty DUI.

An Easton Area School District bus driver fired because of an off-duty DUI arrest will be allowed to return to work, according a ruling by a Northampton County Judge.

The Morning Call reports that Judge F. P. Kimberly McFadden upheld an arbitrator's earlier ruling that John Trusz should be allowed to keep his job.

In 2011, Trusz was arrested—while off duty—on suspicion of drunken driving and subsequently fired by the school district.

He sued, saying other bus drivers had kept their jobs in similar circumstances, and an arbitrator ruled that Trusz was wrongfully fired.

Court records show Trusz entered the first-time offenders program in 2012.

His case may be the last of its kind for Easton schools. A new contract with district bus drivers approved last month allows school officials to fire any employee responsible for driving children
