Dog Neglect Lawsuit Settled by City

Officials call suit frivolous, but say it would have been too costly to fight.

Easton has settled a lawsuit filed by two former sewer plant workers who accused the city of neglecting dogs at its kennel.

Officials said Wednesday the city had paid $80,000 to Jackie Lovering and Katie Pruden, who filed the whistleblower suit last year.

Mayor Sal Panto and City Administrator Glenn Steckman said the suit had no merit, but argued it would have cost too much -- at least another $200,000 -- to continue fighting it.

"Basically, this is about gossip," Steckman told reporters at a news conference at City Hall. "This is gossip run amok."

In all, the city spent $120,000 on the case, between legal costs and the settlement. Of that figure, $70,000 will be covered by the city insurance policy. Easton taxpayers will pay for the other $50,000. Under the terms of the settlement, the city could not disclose how much the womens' employer, Benchmark Analytics, would pay.

City Council voted to approve the settlement Wednesday night. 

Pruden and Lovering had worked for Benchmark Analytics, a Center Valley company. They claimed Benchmark -- which did contract work at the city sewer plant -- fired them after they went to WFMZ-TV to complain about conditions at the dog kennels.

The kennels are on the same property as the sewer plant.

Steckman called the suit "frivolous," and Panto seemed to take personal offense at the idea of dogs being mistreated on his watch.

"I consider these dogs to be my pets while they're in my care," he said.

Panto and Steckman said they never asked Benchmark to fire the women, but simply asked that they not be allowed back on city property. Asked if that didn't amount to the same thing, the mayor said they assumed Benchmark would reassign Pruden and Lovering.

"The last thing we want is to put people out of work," he said.

Lovering -- who attended the news conference "to see what they'd say" -- said she is still out of work, and declined to discuss terms of the settlement.

"I'm just glad it's over," she said, and added she was pleased the suit had led the city to improve conditions at the kennels.

Easton set up its kennel last year in response to a rise in stray dogs and overcrowding at the Center for Animal Health and Welfare. Earlier this year, the city got approval from its zoning board to continue operating the kennels, as what once seemed like a short-term solution became more long-term.

How many lawsuits get paid off because fighting and winning would cost too much. I would rather my taxes go to fighting false accusers than paying anyone who comes up with a "legal" reason to sue the cities and boroughs. I am not saying these women were lying because I do not know. But how many illegitimate suits are paid every year. Go to court, win the case, make the people who bring the suit and lose pay the extra cost. If not, at least any loser can't just decide to sue the city for whatever reason and know they are going to get a settlement. What about the 3 loser's in the Shruty's Pub brawl? We'll get drunk and fight, then they find out they bar fought with OFF DUTY cops and saw $$$$$$$ I gather they got their pay-off for being pathetic citizens as well. I am tired of being bullied by scam artists!
In the case of the dogs, if they were mistreated, then fine. I don't think the dogs got the money though ; (

If the plaintiffs really cared about the dogs, why aren't they demanding that their 'winnings' be turned back to the City under the condition that the funds be used to improve the kennels?

I have to agree that this money should be used to help for the dogs care. It seems that the dogs were not really the issue here. How about we all start hepling instead of complaining who do we call so we can help out I am ready just so me the right direction and who I need to see. Dawn Johnston

With regard to animals being held at Easton Animal Control, it appears the only way people even know stray dogs are waiting to be claimed, is via the "City of Easton Lost/Found Dogs" FB page, which has only about 500 'likes' so far, from what I can tell. Can the City do a better job of promoting the A/C FB page to the residents of the City? Also, there is currently no Foster Program in place. I realize there's a holding period to allow possible owners to claim their dogs, but why can't they wait in a comfy foster home, instead? It would also make room for other strays at the facility. Although I'm sure the kennel management is doing their best... sometimes finding rescue groups to take a dog or two...why not enlist the help of high school students to walk the dogs each evening? It seems there are several ways to improve the current Animal Control policies. Surely if the City can cough up $120,000 for a lawsuit, they could throw some funding into improving the rather stagnant situation these dogs are facing... waiting day after day... when its obvious no one is coming for them. They need a bigger spotlight. thank you.
